Man sued by neighbor over smoke from back yard wood fired oven
« on: January 30, 2023, 03:44:55 PM »
One neighbor (of many) complains that the smoke is "billowing white and opaque" and claims it has caused various maladies.

It seems like it should only smoke a little during startup?

The neighbor has to be suffering from some mental illness.

Chronic oven envy disorder most likely.

Why would the requested chimney extension impact the oven negatively? I would have thought it just had better draw. Not sure a few more feet helps the smoke issue, but I don't think it would impact the oven.

The only think I can think of is that the extension will cost $ which leaves less to spend on toppings   :-D

Probably just bad blood between the neighbors and they have allowed a solvable problem to escalate.

After the last few years of forest fires and smoke, we had a 10 day period where I couldn't go for a walk it was so bad. The first clear day and a neighbor sets up a smoker and starts smoking meat, which I can't recall ever happening before. I restrained myself from complaining and have never seen the smoker since.

I read a story on this and all of the other neighbors love the pizza parties and bring the toppings.  The Jones's better not move to NY if they lose.  Everyone heats with wood here.  My dogs always come in smelling like smoke in the winter.

I think I'd have put another section of flue on the chimney just to keep the peace.
But you'd think 2 houses down the smoke, which should only be there on start up, would have dissipated.
Seems like the neighbour in between is not real concerned?

Word is that the plaintiffs lost by a unanimous jury vote, having failed to provide evidence

Verdict came in!  Unanimous by the jurors that the oven wasn't a nuisance.

Here's a video about it:

Yeah, like Lehto says, at some point in the past 5 years they could have taken a picture or made a video of this dense smoke they are complaining about, or found some corroborating witnesses.

For sure.  Must be some sort of weird feud.  Everyone I know would love having a neighbor two doors down that you could get an occasional wood fired pizza from  :-D   Not surprised at all it was a quick case, but it is odd they'd feel strongly enough to sue and not bring any meaningful evidence.  No pictures, air quality report tests, etc... makes you think there was none to be collected.  Hopefully they don't just file another suit to waste their time now that this ones over.

Some neighbors can be awful that way.

There was an ongoing saga about a double amputee veteran who was the only resident on a rural route when he inherited some money and used it to build a 3-bay auto service garage that he uses to work on his own trucks, lets his friends work on their trucks, do free repairs for other vets, etc. No money changes hands. It's just a disabled vet hanging with his friends and fixing cars.

Then rich people built houses down the road and just could not stand it.

They had the city out on complaints dozens of times and filed multiple civil suits until a judge dismissed the last one with prejudice.
